If you purchase FGB products through our branded websites, there are additional terms and conditions. Please make sure you agree with these terms and conditions prior to making your purchase.

Customer information

You must complete required customer information before placing an online order on any of FGB’s branded websites. You warrant that all information and data provided by you in the customer information fields is accurate, complete and up to date. You must promptly inform FGB if there is a change to this information or data. 

Security

FGB will endeavour to take reasonable steps to ensure that we hold personal information in a secure environment accessed by authorised persons for approved business purposes only. However, no data transmissions via the internet can be guaranteed to be totally secure. FGB will not be held liable for events arising from unauthorised access to personal information.

Price of goods and payment

All prices quoted are in Australian dollars (AUD) and include GST. Prices are subject to review and change at any time. FGB provides payment via credit card and Paypal facilities. Unless otherwise agreed, in order to receive the goods you have ordered, payment must be received by FGB by one of these methods. Upon your order being placed, FGB will provide you with a tax invoice specifying the total price for the goods, including the delivery fee.

While every effort has been made to ensure the accuracy of prices and information displayed, FGB reserves the right to accept or reject your payment offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on the Site, or an error in your order, or we reasonably believe you have not complied with these Terms of Use, or we have previously refused to accept any order(s) from you.

Order confirmation

Placing an order through an FGB shopping cart is confirmed by selecting goods and pressing the Confirm Order button. Orders are deemed to be received by FGB at the time of successful transmission of the order. Payment is processed at the time the order is confirmed.

Delivery

FGB will only deliver to locations within Australia. Shipping and delivery is managed by third party freight providers on behalf of FGB. Please allow up to ten (10) days from receipt of payment to delivery of your order, depending on the delivery location you have specified.

While we endeavour to deliver goods to your nominated address within the time frames indicated, we cannot guarantee delivery times particularly during busy sale periods.

Excluded Delivery Locations & Postcodes

FGB uses our delivery partners road & rail network to deliver Euky Bear products to most states and postcodes within Australia. However, there are certain locations they are unable to deliver.

Due to regulatory requirements, Euky Bear products cannot be shipped by Sea or Air. This means that we are unable to ship to areas that cannot be reached by Road or Rail such as Tasmania and other Island and remote locations. 

In addition, there are certain remote locations which FGB cannot deliver to due to cost or lack of delivery services. FGB reserves the right to accept or decline deliveries to remote locations at its sole discretion. 

Risk and title in the goods

Once paid for, risk and title in the goods passes to you upon delivery or upon collection by you.

Product availability

All products are subject to availability and may be withdrawn at any time. FGB reserves the right to limit supply on orders placed over $AUD300 as well as to place limits on the fulfilment of orders, if multiple orders are placed by the same customer. This is to support as many customers as possible at times of high demand.

To ensure compliance with relevant regulatory requirements, certain Euky Bear products can only be shipped in limited quantities by road & rail. Therefore, to be compliant with our delivery partners road & rail requirements, certain products within the Euky Bear portfolio can be limited in quantity per order.

Refund policy

If you are not satisfied with our products or service and wish to make a claim for a replacement, refund or credit because:

• you believe that an item which was ordered by you has not been provided; or

• you are not satisfied with the quality of the goods you have received

A claim should be sent to cservice@fgb.com.au. An FGB customer service representative will assess your claim once it is received. FGB reserves the right to inspect the goods before making an assessment for claim. All requests for returns or refunds must be lodged within seven days of receipt of goods or 14 days from date of placing your order.

Limited liability

To the extent permitted by law, including Australian Consumer Law, FGB excludes all liability for any claims, loss or damage whatsoever and howsoever caused, arising out of or in connection with this website. By accessing our website, you agree to be liable to us for all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website, any breach of these terms and conditions or negligence under the principles applied by the courts.

The information on this site is intended and applicable for users in Australia only as it adheres to the legislation and guidelines of this country. We make no representation that the website is applicable to, appropriate for, or available to users in locations outside Australia.
